1. DEFINITIONS
1.1 In these Terms and Conditions, the following definitions apply:
- “The Company” shall mean London Sanding LTD, the specialist company appointed to undertake the relevant work, which enters into the Contract with the Client.
- “Client” means the person, company, corporate entity, partnership, or other legal entity contracting with the Company for the provision of the relevant work.
- “Premises” means the location where the work under the Contract is to be carried out.
- “The Contract” means the agreement under which the Company provides the relevant work.
- “The Work” means the services to be undertaken or provided by the Company under the Contract.
1.2 Unless the context requires otherwise, references to the singular include the plural, and references to the masculine include the feminine and neuter genders, and vice versa.
1.3 The headings in these Terms and Conditions are for convenience only and do not affect their interpretation.
1.4 References to any legislation include such legislation as amended or re-enacted from time to time.
2. THE CONTRACT
2.1 These Terms and Conditions shall be incorporated into the Contract.
2.2 These Terms and Conditions may only be amended or varied if agreed in writing by the Company.
2.3 The Client agrees that placing an order for work constitutes acceptance of these Terms and Conditions, which shall form part of the Contract.
2.4 Unless otherwise agreed in writing by the Company, these Terms and Conditions shall prevail over any terms of business or purchase conditions put forward by the Client.
2.5 The Company shall not be obliged to carry out any work that is unlawful. This condition shall prevail over any other agreement between the Company and the Client.
3. QUOTATIONS
3.1 The Company uses metric measurements and average room sizes for telephone or remote quotations. These are for guidance only. Final prices are provided in writing after a Premises inspection.
3.2 Floor restoration services are charged per linear metre, considering the type and condition of the floors. Additional charges may apply for complex materials or details.
3.3 The Company reserves the right to amend the quotation if the Client changes their requirements.
3.4 If actual measurements exceed the quoted size by more than 5%, the Company may adjust the price accordingly.
3.5 All telephone quotes are subject to reassessment after a Premises inspection.
3.6 Quotations not accepted within 90 days may be amended.
3.7 The Company has a minimum charge of £480.00 for any project.
3.8 A call-out charge of £150.00 applies for inspections where issues are caused by natural factors (e.g., weather, humidity) or third-party actions.
3.9 Quotations exclude waste clearance unless otherwise stated.
4. EQUIPMENT
4.1 The Company will provide all necessary tools and equipment unless otherwise agreed.
4.2 The Client must provide adequate water and electricity at the Premises.
4.3 Sanding machinery requires a 240v power supply. The Client must ensure this is available.
4.4 The Client must provide parking permits if required for the work.
4.5 The Client will reimburse the Company for any parking, congestion, or skip fees incurred during the work.
5. PAYMENT, PRICE, AND EXTRAS
5.1 Payments are accepted in cash (up to £10,000), cheque, credit/debit card, or bank transfer.
5.2 A 30% deposit is due upon booking. This is non-refundable if the Client cancels after workers arrive on site.
5.3 The remaining 70% payment, plus any extras, is due upon completion of the work.
5.4 Interest of 8% per annum may be charged on overdue amounts. Unpaid debts may be referred to a debt collection agency, incurring a 25% charge.
5.5 The Company may stop work if payments are overdue or if the Client becomes insolvent.
5.6 The Client will pay for any additional work or variations requested.
6. CONSUMER CONTRACTS REGULATIONS 2013
6.1 If applicable, the Client has a 14-day cancellation period from the date of the Contract.
6.2 To cancel, the Client must inform the Company in writing.
6.3 Refunds will be issued within 14 days of cancellation, minus any work already completed.
7. WORK ISSUES
7.1 Minor repairs are included in the work. Major repairs are chargeable extras.
7.2 The Company is not responsible for pre-existing damage or poor results due to prior wear and tear.
7.3 The Client must ensure rooms are empty before work begins. Furniture removal is available as an extra.
7.4 The sanding process is 95% dust-free, but some dust may be produced.
7.5 The Company is not liable for incidental marking of skirting boards or decorations during work.
7.6 Stairs sanding includes flats and risers only. Additional work is chargeable.
7.7 Colour samples are indicative. Changes after staining begins are chargeable.
7.8 The Company provides four coats of lacquer or two coats of oil/hard wax as standard. Additional coats are chargeable.
7.9 The Client must avoid contact with freshly sealed floors during curing.
8. POSTPONEMENT AND ACCESS
8.1 The Client may postpone work with 48 hours’ notice. A £100 charge may apply.
8.2 The Client must provide reasonable access to the Premises.
8.3 A £30 charge applies for key collection or return.
9. COMPLAINTS PROCEDURE
9.1 Complaints must be made in writing.
9.2 The Company will investigate and attempt to resolve complaints.
9.3 The Client must allow the Company to remedy any defects at its own cost.
10. TIME FOR COMPLETION
10.1 Completion dates are estimates only.
10.2 The Company is not liable for delays due to circumstances beyond its control.
11. EXCLUSION/LIMITATION OF LIABILITY
11.1 The Company is not liable for indirect or consequential losses.
11.2 Liability is limited to twice the Contract price.
11.3 The Company is not liable for accidental damage to items worth £50 or less or damage costing less than £75 to remedy.
12. DATA PROTECTION
12.1 The Company may record phone calls for quality control and record-keeping.
13. SUPPLEMENTARY TERMS
13.1 These Terms and Conditions do not confer rights on third parties.
13.2 The Company may amend these Terms and Conditions at any time.
14. INSURANCE
14.1 The Company holds Public Liability and Employers Liability Insurance up to 5M.
15. CHOICE OF LAW
15.1 The Contract is governed by English Law, and disputes are subject to the jurisdiction of English courts.
